When a rental flat turns into a brothel

Despite all precautions and thorough vetting, it may happen that a tenant turns out not to be as respectable as initially assumed. For example, even after a credit check without negative findings – meaning no irregularities have come to light to date – it cannot be ruled out that a rental nomad settles into your property, or that a female tenant – and in far rarer cases a male tenant – uses the rented flat to receive clients.

 

Many tenancy agreements for private residential lettings (flats or houses) contain a clause prohibiting commercial use, which is of little concern to a tenant engaging in prostitution. Bremen Administrative Court: Apartment prostitution in residential areas is generally unreasonable

Apartment prostitution constitutes unauthorised commercial use of residential premises and is generally inadmissible in purely residential areas, as it does not qualify as a non-disruptive commercial activity (see also Bremen Administrative Court, judgment of 30 June 2010, 1 V 410/10). The disturbance caused to other tenants by the operation of a business is simply unreasonable, and ultimately the property and its surroundings acquire a negative reputation, which in turn can lead to a loss of rental income.
